In what case do I have to do an electrical compliance certificate?

Before selling housing (house or apartment)
When selling housing with a notary, you must send a report of control of the electrical installation to the buyer.
This report may state that the electrical installation is compliant or is non-compliant to regulations.
If after our on-site visit, the installation is declared non-compliant, it is the buyer who will be responsible for having it brought up to standard after the passage of the act (acte de vente).
The possible absence of electrical diagrams is for example one of the possible infringements.

After selling (buying) housing (house or apartment)
If after buying a house or apartment, the electrical installation report list one or more infringements, the new owner has 18 months (starting from the date of sale) to make changes to his electrical installation and ask to create or adapt the necessary change on the location diagram and on the single line diagram. That's when he can apply for a compliance to commit changes to the electrical installation.

The electrical compliance is also required:
- Every 25 years (periodic inspections of residential housing: apartment or house).
- Every 5 years (periodic inspections for shops, restaurant, tertiary... or residential housing in tourist rental).
- During the commissioning of a new facility.
- At a significant extension of the installation.
- At a substantial modification of the facility.

The electrical compliance report with positive conclusion is valid for 25 years, on condition that no modification or extension is made to the electrical installation.

The electrical compliance report with positive conclusion is valid for 5 years in case it is for a place welcoming public such as shops, businesses, offices, tourist rentals (direct hire, Airbnb ...), nurseries, bars, restaurants, snacks, food trucks...

Do I have to do a control of my electrical installation if my property is rented?

The General Regulation on Electrical Installations (Règlement général sur les installations électriques) does not require to perform an electrical check within the context of a lease.
But it is mandatory to carry an inspection of the electrical system every 25 years.
In addition, the owner would normally guaranty the quality of the electrical installation to enable the tenant to occupy the property safely. Insurance may request after a disaster, a proof that the electrical system was in order.

In summary, even if the regulations do not require the owner to produce an electrical compliance report within the context of a lease, the owner should have one made at least once every 25 years. This document allows him at the same time to avoid liability in case of disaster.
